Pilot User Agreement

1. Your Association's Data Use Agreement

Your pilot association (the "Association") has entered into a Data Use Agreement with LadderWatch LLC ("LadderWatch") that establishes how data submitted to the Platform is owned, used, protected, and aggregated. As a Pilot User of the Association, you are bound by that Data Use Agreement with respect to your use of the Platform and the data you submit. A copy is available from your Association administrator. In case of any conflict between this Agreement and the Data Use Agreement, the Data Use Agreement controls.

2. Your Account

Your Pilot User account is personal and may not be shared with, transferred to, or accessed by any other person. You are responsible for keeping your credentials confidential and for all activity that occurs under your account.

3. Submitting Data and Photographs

When you submit reports, photographs, voice recordings, or other content to the Platform, your submissions are governed by your Association's Data Use Agreement, which permits LadderWatch to include them in its compiled database in de-identified form, make them available to other member associations in de-identified form, use them to train computer vision and machine learning models, and develop educational and training materials.

Photographs submitted to the Platform shall not include images depicting the face of any identifiable individual, including pilots, vessel crew, or other persons present during the boarding. You are responsible for ensuring facial features are obscured, cropped, or otherwise removed before submission.

4. Confidentiality and Re-Identification

You shall not attempt to identify any individual pilot, vessel master, or crew member from de-identified data made available through the Platform. You shall not share Platform information, including reports, screenshots, or other output, with persons outside your Association without Association authorization. Your identity as a pilot is not shared with other member associations through cross-member queries.

5. Professional Responsibility

The Platform is a decision support tool. Your professional judgment as a marine pilot, including all decisions regarding boarding, refusal of boarding, and operations, remains your responsibility and is not delegated to or replaced by the Platform.

6. Acceptable Use

You shall not use the Platform for any unlawful purpose, reverse engineer or attempt to derive the source code of the Platform, or use it in any manner that could damage, disable, or impair the Service.

7. Termination of Access

Your access to the Platform depends on your continued affiliation with the Association and the Association's continued LadderWatch membership. Your access may be terminated if you leave the Association, if the Association terminates its membership, or if you violate this Agreement or the Association's Data Use Agreement.

8. Acknowledgment

By creating a Pilot User account or accessing the Platform, you acknowledge that you have read this Pilot User Agreement, understand it, and agree to be bound by its terms together with your Association's Data Use Agreement.
